Terms of Service - Locum

These Terms of Service (“Terms”) govern your use of the Locum platform at locum.to. By creating an account or using the service, you agree to these Terms.

1. Acceptance of Terms

By accessing or using Locum, you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are registering on behalf of an organisation, you confirm that you have authority to bind that organisation.

2. Description of Service

Locum is a marketplace platform that connects healthcare facilities with locum (temporary) professionals. We provide tools for shift management, applicant review, assignment tracking, timesheets, payouts, and invoicing. We are not an employment agency and we do not employ or direct any professionals listed on the platform.

3. User Accounts

You are responsible for:

Maintaining the confidentiality of your account credentials
All activity that occurs under your account
Ensuring that account information is accurate and up to date
Notifying us immediately of any unauthorised use of your account

4. Facility Obligations

Facilities using Locum agree to:

Post accurate and complete shift information including rates and requirements
Comply with applicable employment and labour laws
Process timesheets and payouts in a timely manner
Not discriminate against professionals on protected grounds
Maintain a valid subscription for the features they use

5. Professional Obligations

Professionals using Locum agree to:

Provide accurate profile information and credentials
Maintain valid professional registration and qualifications
Honour confirmed assignments or provide adequate notice of cancellation
Submit accurate timesheets reflecting actual hours worked
Comply with facility policies and applicable professional regulations

6. Payment Terms

Facility subscriptions are billed on a recurring basis (monthly or annual) through Dodo Payments. Subscriptions renew automatically unless cancelled before the renewal date. Refunds are not provided for partial billing periods. The Starter plan is free and does not require payment. Professionals never pay for access to the platform.

7. Prohibited Use

You may not use Locum to:

Post false or misleading shift information
Harvest or scrape user data
Attempt to gain unauthorised access to the platform or other users' accounts
Interfere with or disrupt the platform's operation
Violate any applicable law or regulation

8. Intellectual Property

All rights in the Locum platform - including software, design, and content - are owned by or licensed to Locum. You are granted a limited, non-exclusive, non-transferable licence to use the platform for its intended purposes. Nothing in these Terms transfers any intellectual property rights to you.

9. Limitation of Liability

To the maximum extent permitted by law, Locum is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the platform, including disputes between facilities and professionals, loss of earnings, or data loss. Our total liability to you will not exceed the amount paid by you in the 12 months preceding the claim.

10. Termination

You may terminate your account at any time by contacting us or using the account settings. We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice. Upon termination, your right to use the platform ceases and we may delete your data in accordance with our data retention policy.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated by email or via a notice within the platform. Continued use of the platform after changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the Republic of Namibia. Any disputes will be subject to the exclusive jurisdiction of the courts of Namibia.
