Terms of Service

These Terms of Service (“Terms”) govern your use of the Locum platform, on the web at locum.to and in the Locum app. By creating an account or using the service, you agree to these Terms.

1. Acceptance of Terms

By accessing or using Locum, you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are registering on behalf of an organisation, you confirm that you have authority to bind that organisation.

2. Description of Service

Locum is a marketplace platform that connects healthcare facilities with locum (temporary) professionals. We provide tools for shift management, applicant review, assignment tracking, timesheets, payouts, and invoicing, on the web and in the Locum app for iPhone. We are not an employment agency and we do not employ or direct any professionals listed on the platform.

3. User Accounts

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Ensuring that account information is accurate and up to date
• Notifying us immediately of any unauthorised use of your account

4. Facility Obligations

Facilities using Locum agree to:

• Post accurate and complete shift information including rates and requirements
• Comply with applicable employment and labour laws
• Process timesheets and payouts in a timely manner
• Not discriminate against professionals on protected grounds
• Maintain a valid subscription for the features they use

5. Professional Obligations

Professionals using Locum agree to:

• Provide accurate profile information and credentials
• Maintain valid professional registration and qualifications
• Honour confirmed assignments or provide adequate notice of cancellation
• Submit accurate timesheets reflecting actual hours worked
• Comply with facility policies and applicable professional regulations

6. Payment Terms

Every new facility starts with a 30-day free trial of the Growth plan. No payment details are needed for the trial. When it ends, the facility moves to the free Starter plan automatically and is not charged, unless it has subscribed to a paid plan.

Paid subscriptions are billed monthly or annually through Dodo Payments and renew automatically until cancelled. Upgrades take effect immediately; downgrades take effect at the next renewal date. If you cancel, you keep your plan until the end of the period you have paid for, then move to Starter. Refunds are not provided for partial billing periods. The Starter plan is free and does not require payment. Professionals never pay for access to the platform.

7. Reviews and User Content

After a shift has been worked, the facility and the professional can each review the other: one review per side, within 14 days of the work finishing. A review stays hidden until both sides have submitted theirs or the 14 days are up, and then it is published. You can edit your review while it is hidden, but not once it is published. The person or facility reviewed can post one public response.

You are responsible for everything you post, including reviews, responses and profile details. It must be honest and based on your own experience. We do not tolerate objectionable content: nothing you post may be abusive, harassing, hateful, discriminatory, obscene, or spam, or disclose anyone else's personal information. You keep ownership of what you post and grant Locum a non-exclusive, royalty-free licence to display it on the platform, including on public facility and professional pages.

If a review breaks these Terms, report it from the review itself. We review reports within 24 hours and may hide or remove the content and suspend or terminate the account responsible. In the Locum app you can also block the author of a review, which hides their reviews from you.

8. Prohibited Use

You may not use Locum to:

• Post false or misleading shift information
• Post objectionable content, or harass, threaten or impersonate anyone
• Harvest or scrape user data
• Attempt to gain unauthorised access to the platform or other users' accounts
• Interfere with or disrupt the platform's operation
• Violate any applicable law or regulation

9. The Locum App

The Locum app for iPhone is distributed through Apple's App Store, and your use of it must also follow the App Store's Usage Rules. These Terms are between you and Locum, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support for it, and is not liable for any claim relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

10. Intellectual Property

All rights in the Locum platform - including software, design, and content - are owned by or licensed to Locum. You are granted a limited, non-exclusive, non-transferable licence to use the platform for its intended purposes. Nothing in these Terms transfers any intellectual property rights to you.

11. Limitation of Liability

To the maximum extent permitted by law, Locum is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the platform, including disputes between facilities and professionals, loss of earnings, or data loss. Our total liability to you will not exceed the amount paid by you in the 12 months preceding the claim.

12. Termination

You may delete your account at any time from the Locum app, or by contacting us. Deleting it removes your personal details, such as your name, email address, phone number, photo and address, and signs you out everywhere. Records other users rely on, such as the shifts you worked, your timesheets and payouts, are kept in anonymised form. See our Privacy Policy for what we keep and why.

We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice. Upon termination, your right to use the platform ceases.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated by email or via a notice within the platform. Continued use of the platform after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the Republic of Namibia. Any disputes will be subject to the exclusive jurisdiction of the courts of Namibia.
